www.cubicoolstore.com (hereinafter referred to as "the Site") is published by the company ZECOOLBOX, whose registered office is in ROQUEBRUNE SUR ARGENS (85320) 34C Rue de la Tuilerie, ZAC des Garillans, identified in the RCS of Fréjus under the number 824 646 582 (hereinafter referred to as "the Company ZECOOLBOX"). All orders placed on the Site are subject to these general terms and conditions of sale. The Company ZECOOLBOX reserves the right to adapt or modify these at any time, the version of the general terms and conditions of sale applicable to any transaction being that appearing online on the site www.cubicoolstore.com at the time of the order.

I The Customer

The Customer declares to be a natural person, aged at least 18 years old and to have the legal capacity to place an order on the Site. When registering the Customer's personal data in the "my account" section, the latter must ensure the accuracy and completeness of the mandatory data provided. In case of an error in the recipient's coordinates, the Company ZECOOLBOX cannot be held responsible for the impossibility of delivering the product. The Company ZECOOLBOX reserves the right to cancel any order when the customer's IP address is domiciled in a country different from the billing and/or delivery address.

II The Products

The products offered for sale are those described on the Site. The Company ZECOOLBOX takes the utmost care in presenting and describing these products to best satisfy the Customer's information. However, it is possible that non-substantial errors may appear on the Site, which the customer acknowledges and accepts. In any case, in the event of non-conformity of the product delivered with its description on the Site, the Customer may either exercise his right of withdrawal or implement the Company ZECOOLBOX's conformity guarantee, which will proceed, if necessary, to the exchange or refund of the price (in whole or in part) possibly invoiced.

The Company ZECOOLBOX reminds that the "5L/3L pocket" accessory is reusable but cannot guarantee its lifespan, which depends on both the use made by the Customer and the care taken during cleaning or transportation. The 5L/3L pocket cannot be guaranteed or exchanged after its first use.

III The Order

Order placement on the Site is subject to compliance with the procedure implemented by the Company ZECOOLBOX, which is materialized by a succession of different steps that the customer must follow imperatively to validate his order. Before definitively validating his order, the customer will have the possibility to check the details of it and its total price, and to correct any errors before confirming it to express his acceptance. Any order confirmed by the Customer is a sales contract and acceptance of all the stipulations of these.

The Company ZECOOLBOX reserves the right not to accept an order for a legitimate reason (difficulty of supply / geographical area not served by our delivery provider / problem concerning the understanding of the received order / abnormality of the quantities ordered with respect to the current needs of a consumer) - in this case, the Company ZECOOLBOX will inform the Customer by email. It also reserves the right not to satisfy any request from the Customer with whom there is a dispute or an incident related to the payment of a previous order or who would contravene the provisions of these.

An order confirmation email summarizing the order (products, prices, product availability, quantity...) will be sent to the client by the company ZECOOLBOX. For this purpose, the client formally accepts the use of electronic mail for the confirmation by the company ZECOOLBOX of the content of their order. In any case, invoices are available via the Client's order history.

IV Pricing and Payment Terms

  1. Pricing determination

The prices of the products are indicated in euros, all taxes included for Metropolitan France and the European Union (VAT rate in force at the time of ordering), excluding shipping costs. Once the delivery details have been registered, the total price of the order as well as the shipping costs will be indicated in the shopping cart before proceeding to payment.

ZECOOLBOX reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time of registration of the order, subject to availability.

  1. Payment Terms

The products are payable in cash on the day of the effective order. Payment for purchases can be

made either by:

Credit card or Amex, the Client accesses a dedicated space made available by a banking institution, which ensures the security and recording of the payment order.

Paypal (with or without an account)

  1. The data recorded and kept by ZECOOLBOX constitute proof of the order and all transactions

made. The data recorded by the payment system constitute proof of financial transactions.

V – Delivery

  1. In the case of home delivery

Delivery is made to the address provided by the Client at the time of ordering. ZECOOLBOX shall not be held responsible in any way in the event of delay and/or non-delivery due to an incorrect or incomplete address, or if delivery is deemed impossible. If the package is returned to ZECOOLBOX in such cases, the cost of returning the package will be borne by the customer (€9 excl. VAT), as well as the cost of shipping for a second package. In the event of absence at the Client's home, ZECOOLBOX is not responsible for the policy of Chronopost, which entails depositing the package at a relay point within a fixed perimeter set by Chronopost. The Client will then be notified by SMS or email of the availability of their package and the relay point where they must collect it.

  1. In the case of delivery to a relay point

Delivery is made to the relay point chosen by the Client at the time of ordering. ZECOOLBOX shall not be held responsible in any way in the event of delay or non-delivery due to the closure of a relay point or refusal to accept the package. Chronopost will then be obliged to deposit the package at another relay point. Once the package is handed over to the relay point, Chronopost will notify the Client either by SMS or email of the availability of the package and the deadline for collection. The Client agrees to collect the package within 7 days, failing which the package will be automatically returned to ZECOOLBOX. In this case, the cost of returning the package will be borne by the Client (€9 excl. VAT), as well as the cost of shipping for a second package.

The indicated delivery times are indicative and correspond to the average processing and delivery times. ZECOOLBOX shall not be held responsible for any consequences due to a delay in delivery that is beyond its control.

From Monday to Friday, ZECOOLBOX processes and dispatches orders in less than 24 hours.

The Client will be able to track their package using the package number provided at the time of ordering

VI - Right of Withdrawal

In accordance with Article L. 121-21 of the French Consumer Code, the individual customer has a right of withdrawal, which they may exercise without giving any reason, within a period of fourteen (14) clear days from the delivery of the order, which shall be exercised by returning the new products (unused, not unfolded, in their original packaging).

ZECOOLBOX will refund any sums already paid by the Customer, less any shipping costs, under the conditions set out in Article VII below.

The cost of returning the products shall be borne by the consumer customer, except in the case of a major defect in the article or an error in the processing of the order (color, model, quantity), in which case the costs will be borne by ZECOOLBOX.

Articles purchased during special operations such as "SALES", "BLACK FRIDAY" or any other operation motivated by the liquidation of certain models will not be returned or exchanged (except in the case of a major defect in the article or an error in the processing of the order).

VII - 30-day Return

ZECOOLBOX offers individual customers the option to return an item within 30 days from the date of order, without giving any reason, provided that the item is returned unused, not unfolded, and in its original packaging.

The return of the item must be made at the expense of the Customer and with the carrier of their choice, and after having informed ZECOOLBOX by mail at ZECOOLBOX SAS - 34c Rue de la Tuilerie - ZAC des Garillans - 83520 Roquebrune sur Argens or by email at contact@cubicoolstore.com.

Once the article has been received and certified as conforming to be put back into stock, ZECOOLBOX will proceed with the refund of the article, excluding any delivery costs paid at the time of the order. The refund will be made using the same method of payment chosen by the customer at the time of the order, less any shipping costs.

VIII – Refunds

Refunds for products under the circumstances mentioned in Articles II, VI, and VII will be processed by ZECOOLBOX within a maximum of 30 days upon receiving said products (unused, unfolded, and in their original packaging). The refund will be processed using the same payment method chosen by the customer at the time of purchase, minus shipping fees.

IX - Liability

ZECOOLBOX shall not be held liable for any material damage or bodily harm resulting in minor or serious injuries or death caused by personal modifications made to the product, negligence, or improper use outside of the initial purpose of our products by the Customer. ZECOOLBOX reminds customers that the products sold are not suitable for children under 12 years old. ZECOOLBOX is not responsible for beverages consumed by the customer during the use of products sold on the website www.cubicoolstore.com and reminds customers that excessive alcohol consumption is hazardous to health.

X - Applicable law

Any order automatically implies the customer's adherence to the general terms and conditions of sale. These general terms and conditions of sale are governed by French law. In the event of a dispute, only French courts shall have jurisdiction. In the event of difficulty or complaint regarding an order, the customer may contact the Customer Service to find an amicable solution.

XI – Data protection

Personal information collected by ZECOOLBOX during a customer's order is necessary for transaction management and may be communicated, in whole or in part, to ZECOOLBOX service providers involved in order fulfillment. The customer is informed that this same personal data may also be collected by an organization responsible for analyzing orders and combating credit card fraud. In accordance with French Data Protection Law No. 78-17 of January 6, 1978, the customer has the right to access, modify, oppose, and delete any data concerning them.

XII - Intellectual Property

The entire content of the Site or any advertising documentation (illustrations, texts, labels, trademarks, images, videos) is the property of ZECOOLBOX or is used with the authorization of the owners of the rights in question. Any full or partial reproduction, as well as the creation of hypertext links, is prohibited unless expressly authorized by ZECOOLBOX. The products offered on the website www.cubicoolstore.com, namely the CubiCool® single, the CubiCool® double, and the 5L pouch, have been the subject of either a trademark or a patent application with INPI, and any copies will be prosecuted.
